The Franchise Disclosure Document contains 23 numbered items covering important information about the franchise offering. The proposed agreements and attachments are also part of your review.
Approach it as a connected set of documents. A support description, cost schedule, and agreement clause may address different sides of the same responsibility. Use the FDD to connect those responsibilities with the costs and commitments that apply to your opportunity.
Separate a qualification requirement from a fee or cost-to-open estimate. Then connect the disclosed investment categories with your property, financing, and working-capital plan.
Read every item, not only these starting points. Use the document structure to connect your questions with the relevant disclosures.
Write down the owner tasks, costs, and support arrangements your plan assumes. Compare them with the disclosures and proposed agreements. Identify where something is included, optional, conditional, or your own responsibility.
For example, a description of payroll support should connect with the activities performed, information you supply, costs, and review obligations. A territory description should connect with the rights and restrictions in the agreement.
The FTC’s Franchise Rule generally requires delivery of the FDD at least 14 days before signing an agreement or paying the franchisor or its affiliate. Coordinate the document review and any applicable requirements with your attorney.
Use the review period to resolve questions rather than simply wait for a date. Keep the document version, attachments, proposed agreements, and written clarifications together so your decision is based on the same information.
